YOUTRAINFITNESS TRAINING AND EXERCISE POLICIES

OVERVIEW

Your fitness goals are important to us and we are committed to helping you achieve them.  Our training policies are in place to help facilitate and communicate our expectations for this and future trainings.  Please read our policies carefully.

1.0 TRAINING HOURS AND FACILITY HOURS

We operate a private facility.  Private personal training and exercise instructions are scheduled by appointments only Monday – Friday from 6:00am – 12:00pm and 4:00pm – 8:00pm.  On Saturdays, our sessions are scheduled from 7:00am – 12:00pm.  Sessions scheduled outside of these hours are also by appointment only.  We are closed on Sundays; however, we may offer special events or classes at the facility on recurring occasions.  Clients may contact YOUTRAINFITNESS® during these hours at 919.Six27.8348 (919.NC.R.U.FIT) or trainer’s email to learn of trainer’s availability.  Facility hours are the same as training hours.

2.0 SERVICES WE OFFER

The services that we offer are 1-on-1, (1 person with 1 trainer) private personal training, Private partner (2 people with 1 trainer) training, or private trio (3 people with 1 trainer) training.  Each training session may last from 30 to 60 minutes based on our training offerings that match your preference.  All training sessions will occur in-person at our personal training facility at 5611 NC Highway 55, Suite 102, Durham, NC 27713.  Our current class offering is a stretching class to help participants improve their flexibility

3.0 COMMUNICATION VIA EMAIL

So that your trainer can remain organized, please communicate all scheduling appointments through the trainer’s email only.  Text messages or verbal request for scheduling, rescheduling, or canceling appointments are not acceptable.

Please respond to all email communications (requests) from your trainer within 24 hours (excluding weekends and holidays).  Your trainer is committed to giving your requests the same level of importance.

4.0 TYPE OF PACKAGES AND RATES OFFERED

We offer private personal training packages as a single session, 4 sessions, 8 sessions, and 12 sessions (if you would like to purchase more than 12 sessions at one time, please contact us).  The price for each session will vary.  The larger the package purchased the lower your rate.  The more frequently you train per week the lower your rate.

As mentioned previously, YOUTRAINFITNESS® is a private personal training facility.  Our rates include a flat monthly membership fee of $32 to train at our facility.  Your $32 membership fee provides exclusivity which entitles you to train at our facility without any uninvited guests during your session. We value your privacy to train in a space that allows you to perform your best!

Our purchased training pages are subject to expiration within three months to 1 year from the date of purchase.  We reserve the right to increase our private personal training packages and member fee as our costs increase.  Packages purchased under our price lock sale will not increase as long as our members maintain their monthly membership.   In addition to a reduce training package, membership gives you the opportunity to secure a training slot of your choice, if available, and to retain the slot for as long as your membership is active, even if you take a brief break from training.  Upon returning, you may continue in your same training slot if desired.

5.0 PAYMENTS AND DUE DATES

ALL fees are paid prior to service being rendered.  If a client intends to renew a training package, the training package must be paid from the point of receiving an invoice or no later than the start of the new packaged session.  YOUTRAINFITNESS® will notify client when s/he has five sessions or less remaining.  Clients who are members will pay an additional monthly membership fee.  This fee (month(s) owed) will be added to the invoice.

As a convenience we offer a few ways that clients can pay for their services.  We accept checks (business and personal) and money order payable to YOUTRAINFITNESS, L.L.C.). We also accept credit cards on our website via our Bookeo Booking System.  Payments by credit card on our website will include an additional 4% surcharge.  To help support your 4% online payment fee, we offer an incentive of earning credits for each fee that you pay that will allow you to earn free personal training sessions.  More details about how you earn the credits toward free personal training sessions are mention below.  (see incentives to clients)

6.0 ATTIRE FOR EXERCISING AND FRAGRANCES

Proper attire includes clean t-shirt, shorts, sweatshirt, sweat pants, tights or other supportive clothing that restrains movable body parts.   Athletic shoe that’s supportive such as cross-trainers are suitable. Additionally, maintaining good personal hygiene is an important aspect of fostering a positive and productive training experience for the client and trainer. Clients should be mindful that strong fragrances (e.g., perfumes, colognes, scented lotions) can be distracting or cause allergic reactions for some individuals.  Clients are asked to use scented fragrances sparingly or choose unscented products.

7.0 PHYSICAL CONTACT (SPOTTING OR CUEING) DURING SESSIONS

When working with a trainer, physical touch (spotting or cueing) may be necessary to help ensure that the client is performing the exercise properly.  When possible, the trainer will alert the client to the type of physical touch (cue) that may occur.  If you do not wish to receive a physical cue by your trainer for any reason, please let your trainer know before the first session begins.  The client will ALWAYS have the right to refuse any physical touch (cue).

8.0 CODE OF CONDUCT BETWEEN TRAINER AND CLIENT

The relationship between the trainer and client is professional and fostered for the trainer to support the client in working toward reaching his/her fitness goals.  The client’s responsibility is focused on the objectives agreed upon at the start of the trainer-client relationship.  At no time during the trainer-client relationship should the conduct on the part of the trainer or client become unprofessional.  Such unprofessional behavior may consist of, but not limited to, harassment, intimacy, using offensive language, making inappropriate comments, or inappropriate touching of any kind.  Unprofessional behaviors are STICKILY PROHIBITED by the trainer and client!

9.0 PACKAGE EXPIRATION

Unless otherwise stated, all regular personal training sessions will expire three months to 1 year after purchase.  With this in mind, please consider purchasing only the number of sessions you will be able to use within three months to 1 year.

10.0 REFUND AND SESSIONS TRANSFERABILITY

All purchased sessions are non-refundable and non-transferable.

11.0 INCENTIVES TO CLIENTS

We offer two objective incentives.

1st objective incentive – To support you by supporting us, we give away 1 complimentary session when existing clients refer someone who purchases a package or the equivalent number of sessions of 12. 

2nd objective incentive – As mentioned above, if you purchase any service (e.g. monthly membership fee and/or training package using a credit card via the Bookeo software system on our website), we will give you training credits that may be used toward earning free private personal training sessions.  For example:  If you purchase 12 – 1-hour private personal training sessions as a member, your current total cost will be $1,064.96 (i.e. $1,024 regular fee [includes membership cost] + 4% Online Booking Fee of $40.96).  When you make this payment using a credit card, you will earn 41 credits.  When you earn a total of 80 credits in booking fees, you will earn a free private personal training session.  This free personal training session will be earned when you renew your package of 12 – 1-hour private personal training sessions.  This incentive is exclusively for clients who pay for services via our Bookeo software system.

12.0 LATENESS AND CANCELLATION

It is the responsibility of each client to be present and on time for each training session.  If the client is less than 15 minutes late, the workout will continue as scheduled and may end at the prearranged time.  If the client is more than 15 minutes late (without advanced communication of the circumstances), the session may count as a cancellation and the client may be charged for that training session.  If the trainer is late, the client will receive the full scheduled session.  An example of advanced communication is “a client is driving in heavy traffic and calling to notify the trainer of the situation.”  Upon arrival the session may occur and end at the prearranged time).

Our clients rescheduling, cancellation and absence position are firm!  A 24-hour’s or more notice is required for all rescheduling and cancellations.   If a client reschedules or needs to cancel with less than 24-hour’s notice, the client will be charged for that session.  If the rescheduling or cancellation is less the 24 hours as a result of severe weather conditions or a medically documented event such as severe illness or other condition from which the client is not expected to recover, the client will not be charged for the cancellation.  Abuse of this leniency is not allowed.  In order to maintain training consistency, the client is responsible for contacting his/her personal trainer by calling 919.Six27.8348 (919.NC.R.U.FIT) or emailing the trainer to reschedule their next appointment if necessary.

Equally our trainer is accountable to each client.  If the personal trainer cancels a session with less than 24-hour’s notice, under the same client conditions, the client will be given a FREE session.

13.0 TERMINATION OF SERVICES

Mistreatment of any kind WILL NOT BE TOLERATED. YOUTRAINFITNESS® personal trainer reserves the right to terminate any training relationship IMMEDIATELY if the client or client’s guest demonstrates ANY unprofessional behavior to include abusive conduct toward other clients, guests or staff.  WE ARE FIRM ON THIS POSITION! If a client wishes to terminate their exercise program with YOUTRAINFITNESS® before completing all scheduled sessions, the client must do so in writing no later than one week in advance. Cancelling with less than one week in advance will result in a 1 session charge (received as an invoice) based on the client’s current package.  Note: session purchased are non-refundable.

14.0 MAKING SCHEDULE ADJUSTMENT

If a client wishes to change their training schedule (for example, switching training days and times from 8:00am Mondays and Wednesdays to Tuesdays and Thursdays or frequency (for example decrease training frequency from 3x per week to 2x per week) the client must do so in writing (email) at least one week in advance. The trainer will then discuss with client the request and review exercise goals with client to identify changes needed based on the new schedule and/or training frequency.

If the trainer wishes to make a schedule adjustment, the trainer will discuss with the client to determine other possibilities (dates and times) for training so that an agreement can be met for both parties.  If an agreement cannot be met, the trainer agrees to continue with the current schedule until the end of the client’s current package unless it is urgent that the schedule adjustment be made immediately.  The trainer reserves the right to make such decision.

15.0 CHANGES TO POLICY

YOUTRAINFITNESS® reserves the right to review and modify the training policies and fees periodically.  Modifications to policies and fees will not affect the client’s current personal training agreement.  When policies and rates are adjusted, client will receive notice via email.

16.0 USE OF CLIENT INFORMATION

The information obtained in connection with this exercise program will be treated as privileged and confidential and will not be released or revealed to any person without the clients expressed written consent except where permissible by law.  We do ask that clients agree to the use of any information which is not personally identifiable for research and statistical purposes so long as the information does not identify the client or provide facts which could lead to their identification. Personal information and data, however, will be used only by YOUTRAINFITNESS® in the course of prescribing exercise for the client and evaluating the client’s progress in the program.

17.0 USE OF SUBSTANCES

Using substances such as tobacco, marijuana, alcohol, non-prescription drugs or any other product that may cause impairment are not allowed prior to the start of any session. First violation will be a warning or termination of trainer-client relationship.

18.0 WEAPONS

Weapons of any kind are not allowed in the facility per North Carolina General Statute § 14-415.11(c)Violators could face misdemeanor or felony charges depending on the circumstances.

19.0 CLIENTS, MEMBERS, VISITORS OR GUEST USE OF RECORDING DEVICES

Unauthorized photography or video recording is NOT PERMITTED on the YOUTRAINFITNESS® premises since the personal training facility is private.

To safeguard the confidentiality of our visitors and members, it is forbidden to take pictures or videos within the building without the facility owner’s prior consent. 

  • Members and visitors may not be video recorded or photographed without their written authorization, even with permission.  An exception may be, the trainer may video recorded or photograph the client while the client is performing an exercise for the purpose of showing client the proper form for performing an exercise.
  • A warning will be issued if it is found that a client or visitor is filming personal training sessions or exercise classes without authorization. The training relationship between the trainer and the client or visitor will terminate immediately on the first or upon the next incidence. Sessions or classes that have already been purchased will not be refunded.

The individual who was filmed without their consent and the facility owner may pursue further legal action.

20.0 EXERCISE PROGRAM DELIVERY

The write-up of a client exercise program is not automatically included as a free service when doing the following: 1-on-1 private personal training, private partner training, private trio training or any other training service we provide.  Writing-up a client’s program may require extensive resources and additional time beyond the training process.  As a courtesy, the trainer will provide one-lifetime complimentary exercise program write-up at no charge.  If the client would like additional exercise program write-ups, the client agrees that there will be one deducted session from the client’s account per write-up.  There is no limit to the number of write-ups with each deduction.
